1. Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of rapidpetals.com (the “Website”) and any order, enquiry, or transaction placed through the Website, by phone, or through any communication channel linked from the Website.

By accessing the Website, creating an account, placing an order, submitting a review, requesting delivery or pickup, or otherwise using our services, you agree to be bound by:

these Terms;

  • our Privacy Policy;
  • our Refund and Returns Policy; and
  • any product-specific, order-specific, quotation-specific, or checkout-specific terms made available to you.

By continuing to use the Website, you also acknowledge that the Website may use cookies, logs, tags, scripts, plug-ins, APIs, pixels, session technologies, and similar tools as described in our Privacy Policy and any notice or preference interface made available on the Website.

If you do not agree, do not use the Website or place an order.

3. Eligibility

You may use the Website only if you are legally capable of entering into a binding transaction under applicable law.

If you are under 18 years of age, you may use the Website only under the involvement and supervision of a parent or lawful guardian. We do not knowingly market to or intentionally accept direct orders from minors.

By placing an order, you represent that the information you provide is true, accurate, current, and complete.

4. Account Registration and Security

You may be required to create an account to use certain features.

You agree to:

  • provide accurate and complete registration information;
  • keep your login credentials confidential;
  • promptly update account details if they change;
  • ensure that saved addresses, contact numbers, and recipient details are accurate; and
  • notify us immediately if you suspect unauthorised use of your account.

You are responsible for activity carried out through your account to the extent arising from your failure to safeguard your credentials, device, or access methods, subject to applicable law.

We may use automated or manual security measures, including login monitoring, session controls, rate limiting, reputation-based filtering, malware or abuse scanning, audit logging, temporary blocks, verification challenges, and similar protective measures to safeguard the Website, customer accounts, and business operations. You must not attempt to bypass, disable, or interfere with such measures.

We may suspend, restrict, or terminate an account if we reasonably believe there has been fraud, misuse, unauthorised access, legal non-compliance, abusive conduct, security risk, or breach of these Terms.

5. Nature of Products; Freshness; Natural Variation

Rapid Petals sells flowers, bouquets, floral arrangements, floral gifting products, fresh produce, and related services. Floral products and fresh produce are natural, seasonal, and perishable.

You acknowledge that:

  • flowers and fresh produce naturally vary in shade, bloom size, stem length, fragrance, texture, and longevity;
  • actual products may vary slightly from photographs because of seasonality, freshness, lighting, display devices, stock availability, and handcrafted assembly;
  • wrapping, fillers, foliage, ribbons, containers, and accessory elements may vary from display images unless expressly specified as exact; and
  • vase life and freshness after delivery depend on the flower variety, transit conditions, ambient temperature, handling, and care after delivery.

We do not guarantee identical reproduction of a display image.

6. Availability and Substitutions

Product availability is subject to stock, seasonality, freshness, quality checks, logistics, and serviceability.

Where exact flowers, foliage, fresh produce, colours, fillers, wrapping, or accessories are unavailable or unsuitable due to freshness or supply constraints, we may make reasonable substitutions of similar style, colour theme, and overall presentation, using items available.

If an order is expressly dependent on an exact flower variety, exact colour, or exact accessory and a reasonable substitute is not suitable, we may:

  • contact you for revised instructions;
  • offer an alternative;
  • reschedule fulfilment; or
  • cancel the affected portion of the order and refund any amount received for that portion.

7. Product Information, Pricing, and Taxes

All prices displayed on the Website are subject to change without prior notice until an order is accepted.

Unless otherwise stated:

  • prices are in Indian Rupees;
  • applicable taxes, if any, will be shown as required by law;
  • delivery, handling, or other charges, if applicable, will be shown at checkout or otherwise communicated before order confirmation; and
  • the final payable amount is the amount shown at the time of order acceptance.

We make reasonable efforts to ensure descriptions, images, and prices are accurate. However, errors may occasionally occur. We reserve the right to correct typographical, pricing, stock, or display errors before accepting an order.

8. Order Placement and Acceptance

When you place an order, you are making an offer to purchase.

An automated acknowledgement of receipt does not by itself mean that your order has been accepted.

An order is accepted only when we expressly confirm that we have accepted it for processing or fulfilment, or when we dispatch / tender the order for delivery, whichever occurs earlier.

We may use internal systems and third-party website-management, analytics, security, communication, verification, or operational tools in connection with website administration, order capture, diagnostics, fraud prevention, customer support, and performance monitoring. The use of such tools does not change the point at which an order is accepted under these Terms.

We may refuse, limit, reschedule, partially fulfil, or cancel an order for legitimate reasons, including:

  • product unavailability;
  • freshness or quality concerns;
  • non-serviceable location;
  • inaccurate or incomplete address or contact details;
  • suspected fraud, abuse, or unauthorised transaction;
  • pricing or listing errors;
  • inability to contact you where clarification is required;
  • unsafe delivery conditions;
  • inability to honour a requested delivery timing without unreasonable operational, freshness, quality, or safety risk;
  • unlawful or offensive card-message content;
  • force majeure or operational disruption; or
  • other business, legal, compliance, or technology-related reasons.

Where we reasonably determine that the originally requested or displayed timing cannot be met, we may contact you for clarification, propose an alternative, reschedule fulfilment, partially fulfil the order, or cancel the order, as appropriate.

If we cancel an order after receiving payment, we will refund the amount received for the cancelled order or cancelled portion, subject to applicable law.

9. Payment Terms

Payment methods available from time to time will be shown on the Website or otherwise communicated to you.

At present, orders may be fulfilled on payment-on-delivery / payment-on-fulfilment terms, including payment by cash, UPI, card, or other lawful methods made available by us. We may add online payment options in future.

You agree that:

  • you will pay the full amount due for your order using an authorised payment method;
  • payment must be completed at checkout, before pickup, or at delivery, as applicable;
  • we may refuse delivery or release of goods if payment is not made as required; and
  • you will not misuse chargeback, reversal, or dispute mechanisms.

We do not store card credentials, CVV, UPI PINs, or bank credentials on our own Website database.

10. Delivery, Same-Day Delivery, and Pickup

Delivery areas, available slots, operational cut-offs, and same-day delivery eligibility may vary depending on time of order, stock, freshness and quality checks, payment status, weather, traffic, staffing, recipient location, access restrictions, workload, and business conditions.

Same-day delivery in Bengaluru may be available for eligible orders placed before 4:00 PM IST, subject to product availability, delivery location, recipient availability, traffic, weather, and other operational constraints. The 4:00 PM IST cut-off is an operational guideline and not an absolute or guaranteed delivery commitment, even if a same-day option is shown on the Website.

Orders placed after 4:00 PM IST will generally be scheduled for the next available delivery slot. In limited cases, we may accommodate a same-day request after the cut-off, but only upon separate confirmation and subject to operational feasibility.

Delivery times, same-day delivery indications, and requested delivery slots are estimates only.

By placing a delivery order, you agree that:

  • you will provide complete and accurate delivery details, including recipient phone number, landmark, gate / block / floor details where relevant;
  • we may contact the sender and/or recipient for delivery coordination;
  • apartment, office, hospital, hostel, hotel, campus, gated-community, or institutional deliveries may be subject to local entry and handover rules;
  • time-specific delivery within an exact hour is not guaranteed unless expressly agreed in writing by an authorised representative of Rapid Petals; and
  • where direct handover to the named recipient is not reasonably possible, and where it is customary or reasonably necessary at the delivery location, delivery may be completed through reception, security, front desk, concierge, office desk, or another apparently responsible person at the address, unless you have clearly instructed otherwise and we have agreed to such instruction.

If delivery cannot be completed because of incorrect details, recipient unavailability, refusal to accept, restricted access, inability to contact the customer or recipient, or other customer-side / recipient-side circumstances, we may:

  • attempt reasonable contact;
  • reschedule delivery subject to operational feasibility;
  • charge re-delivery or re-handling costs where applicable; or
  • treat the order as a failed delivery caused by customer / recipient-side circumstances.

If we are unable to complete a requested same-day delivery because of stock issues, freshness preservation, safety, serviceability, weather, traffic, access restrictions, or other operational constraints, we may reschedule the order, offer an alternative, partially fulfil the order, provide re-delivery, replacement, store credit if agreed, or refund any amount received for the unfulfilled portion, as appropriate and subject to applicable law and our Refund and Returns Policy.

For pickup orders, you must collect within the agreed time window. Delayed pickup may affect product condition.

Risk in the goods passes to you or the recipient upon delivery at the address, handover at the delivery point, or pickup, as applicable.

11. Customer Responsibilities

You are responsible for:

  • ensuring all customer and recipient information is accurate;
  • ensuring you are authorised to provide recipient information;
  • ensuring any greeting-card or custom message content is lawful and appropriate;
  • promptly checking order confirmation details;
  • informing us of any allergies, access restrictions, or special conditions that materially affect fulfilment, where relevant; and
  • inspecting the order promptly on delivery or pickup.

We are not responsible for loss or deterioration arising from inaccurate information, delayed pickup, customer-side handling, recipient-side storage, or failure to follow care instructions.

12. Reviews, Feedback, and User Content

If you submit reviews, ratings, testimonials, feedback, photographs, or other content, you represent that:

  • the content is true to the best of your knowledge;
  • you have the right to submit it;
  • it does not infringe any third-party rights;
  • it is not unlawful, misleading, defamatory, abusive, obscene, threatening, hateful, discriminatory, or otherwise objectionable; and
  • it does not contain private, confidential, or sensitive information about any person.

You grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable right to use, reproduce, publish, display, adapt, translate, distribute, and store such content for customer-service, marketing, moderation, legal, and operational purposes.

We may moderate, reject, remove, or disable user content at our discretion acting reasonably.

13. Intellectual Property

All content on the Website, including text, photographs, graphics, layouts, logos, trademarks, product names, designs, website structure, and other materials, is owned by or licensed to us unless otherwise stated.

You may not copy, reproduce, republish, distribute, modify, reverse engineer, scrape, commercially exploit, or create derivative works from any part of the Website without our prior written permission, except as permitted by law.

14. Prohibited Uses

You must not:

  • use the Website for any unlawful purpose;
  • submit false, misleading, or fraudulent information;
  • impersonate another person;
  • interfere with or disrupt the Website, servers, or networks;
  • introduce malware, bots, scripts, scraping tools, or harmful code;
  • attempt unauthorised access to any system or account;
  • use the Website to harass, abuse, threaten, or defame;
  • submit false reviews or manipulate ratings;

We may add, remove, suspend, replace, or reconfigure such technologies, integrations, or providers from time to time without prior notice where reasonably necessary for security, compliance, website operations, features, diagnostics, measurement, search visibility, communications, or general business management.

The Website may also contain links to, or embedded content from, third-party websites, platforms, maps, social media services, video services, payment interfaces, or other external services.

We do not control third-party websites or services and are not responsible for their availability, content, terms, privacy practices, or performance. Your use of such third-party services is governed by their own terms and policies.

16. Disclaimers

To the maximum extent permitted by law:

  • the Website is provided on an “as available” basis;
  • we do not guarantee uninterrupted, timely, secure, error-free, or vulnerability-free Website operation;
  • we do not guarantee that every product will always be available;
  • we do not guarantee exact visual matching of natural floral products;
  • references on the Website, product pages, banners, FAQs, emails, messages, social media pages, advertisements, WhatsApp communications, or other customer communications to “same-day delivery”, “today delivery”, “fast delivery”, or similar expressions describe an available service category or operational objective for eligible orders and shall be read together with the applicable cut-off time, serviceability limits, and operational conditions stated on the Website or in these Terms;
  • same-day delivery, where offered, is a convenience feature and best-efforts service for eligible orders and is not an absolute, unconditional, penalty-backed, or fixed-time guarantee unless we expressly agree otherwise in writing through an authorised representative;
  • we do not guarantee a fixed vase life or post-delivery longevity;
  • the Website may rely in whole or in part on third-party infrastructure, integrations, plug-ins, modules, scripts, tags, pixels, communication systems, security tools, analytics tools, or search-related services, and we do not guarantee uninterrupted availability or perfect performance of any such third-party component;
  • analytics, diagnostics, reporting, verification, attribution, search, or measurement data may be delayed, sampled, estimated, incomplete, unavailable, or inaccurate;
  • search-engine indexing, ranking, title links, snippets, cache entries, metadata presentation, webmaster data, and similar search-display outcomes are not fully within our control and are not guaranteed; and
  • security or anti-abuse measures may challenge, throttle, restrict, or block access where reasonably necessary to protect the Website, users, data, or operations.
Technical Systems Disclaimer

We use reasonable efforts to maintain our operational, security, and monitoring systems, including website, communication, and CCTV systems. However, such systems may be affected by maintenance, power failure, internet or telecom outage, device malfunction, software error, storage limitation, cyber incident, or other technical or operational factors. Accordingly, we do not guarantee uninterrupted availability, continuous operation, recording, preservation, or retrievability of any technical or monitoring system at all times.

Nothing in these Terms excludes or limits any non-waivable rights available to consumers under applicable law.

17. Limitation of Liability

To the fullest extent permitted by law, and subject to any non-excludable statutory rights:

  • we shall not be liable for indirect, incidental, special, punitive, or consequential loss, including loss of profit, goodwill, opportunity, expected savings, search visibility, or marketing opportunity;
  • subject to applicable law, we shall not be liable for delay, rescheduling, or non-completion of a requested same-day delivery or other estimated delivery timing to the extent caused by product unavailability, freshness preservation, quality concerns, incorrect or incomplete information, recipient unavailability, weather, traffic, access restrictions, staffing constraints, safety concerns, or other circumstances beyond our reasonable control or reasonable operational judgment;
  • subject to applicable law, we shall not be liable for outages, access issues, functionality issues, or measurement discrepancies arising from hosting, network, DNS, certificate, browser, device, theme, plug-in, extension, embedded content, analytics, security, anti-abuse, search-engine, telecom, cloud, or other third-party technology factors beyond our reasonable control;
  • where a delivery timing request cannot be met, our responsibility will ordinarily be limited, at our option and subject to applicable law, to rescheduling, re-delivery, replacement, store credit if agreed, or refund of any amount actually paid for the unfulfilled portion of the affected order; and
  • our total aggregate liability arising out of or in connection with any order, claim, or transaction shall ordinarily not exceed the amount actually paid to us for the specific order giving rise to the claim.

This limitation does not apply to liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, or any liability that applicable law requires us to bear.

18. Indemnity

You agree to indemnify and hold harmless Yashken Fresh Private Limited, Rapid Petals, and their directors, employees, and authorised personnel from losses, claims, liabilities, damages, and reasonable costs arising out of:

  • your breach of these Terms;
  • your misuse of the Website;
  • your misuse of the items;
  • your unlawful or infringing user content;
  • false or inaccurate customer or recipient information supplied by you; or
  • your violation of any applicable law or third-party rights.

19. Suspension, Restriction, and Termination

We may suspend, restrict, or terminate access to the Website or your account, or refuse future orders, if we reasonably believe there has been:

  • breach of these Terms;
  • fraud or suspected fraud;
  • abusive behaviour toward staff;
  • repeated failed deliveries caused by customer-side circumstances;
  • misuse of refunds, complaints, reviews, or payment mechanisms; or
  • legal or operational necessity.

Termination does not affect rights and obligations that accrued before termination.

20. Force Majeure

We will not be liable for delay, non-performance, rescheduling, deterioration, or cancellation caused by events beyond our reasonable control, including:

  • severe weather;
  • flood, fire, epidemic, pandemic, or public emergency;
  • traffic disruption;
  • strike or labour disruption;
  • power, telecom, internet, or platform outage;
  • government restrictions;
  • civil disturbance or war;
  • crop failure or supply-chain disruption;
  • transport failure; or
  • any other force majeure circumstance.

Where feasible, we may offer rescheduling, substitution, partial fulfilment, store credit, or refund, depending on the circumstances and applicable law.

21. Event, Corporate, Bulk, and B2B Orders

Event, corporate, institutional, bulk, or GST-linked orders may be governed by separate quotations, purchase orders, invoices, or written terms.

Where a separate written commercial document exists, that document will prevail over these Terms to the extent of any inconsistency.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to any non-waivable rights you may have under applicable consumer law to approach a competent consumer commission or other forum, the courts at Bengaluru, Karnataka shall have jurisdiction over disputes arising out of or relating to these Terms, the Website, or transactions with us.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in law, operations, store locations, delivery methods, payment systems, website features, technology stack, analytics or security practices, communication channels, or business requirements.

Updated Terms will be posted on the Website with the revised “Last Updated” date. Continued use of the Website after such update constitutes acceptance of the updated Terms.

24. Severability and Waiver

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force to the extent permissible.

Any failure by us to enforce a provision on one occasion shall not amount to a waiver of that provision or of any other provision.
